TERMS & CONDITIONS OF HIRE AGREEMENT
The Lessor agrees to provide, and the Lessee agrees to hire, the equipment specified herein, subject to the terms and conditions stated in
this Agreement, together with the inclusions and exclusions outlined in Annexure 1 and the Hire Quotation, all of which shall form an integral part of this Hire Agreement.
Acceptance of the equipment at the site by the Lessee shall constitute full and unconditional acceptance of all terms and conditions contained herein, unless otherwise agreed in writing by both parties.
1. Hire Period and Termination
The hire period shall commence from the time the equipment departs from the Lessor’s yard, irrespective of transportation arrangements, and shall continue until the equipment is returned to the Lessor’s yard.
The Lessee shall provide a minimum of twenty-four (24) hours’ prior written notice for termination or off-hire of equipment. All off-hire notifications must be submitted via email.
2. Rates and Working Hours
Unless otherwise agreed in writing, the applicable hire rates shall be based on the following usage:
• Operated Equipment: 10 hours per day, 60 hours per week, 260 hours per month.
• Non-Operated Equipment: 12 hours per day, 84 hours per week, 360 hours per month.
Any usage exceeding the above limits shall be charged on a pro-rata basis, calculated in accordance with the applicable hourly rates.
3. Hirer’s Responsibilities
The Lessee shall be solely responsible for:
• Supplying all fuel, lubricants, oils, and greases required for operation.
• Carrying out routine daily inspections and basic maintenance in accordance with the manufacturer’s recommendations.
• Ensuring that all operators are qualified, competent, and adequately trained to operate the equipment safely.
• All punctures and tyre-related damages during the hire period.
• Arranging all necessary site access permits, entry passes, and approvals required for delivery, operation, and collection of equipment.
4. Maintenance and Repairs
The Lessor shall be responsible for major maintenance of the equipment.
However, any damage, misuse, negligence, or repairs required beyond fair wear and tear shall be repaired by the Lessor and charged to the Lessee at applicable rates.
5. Loss, Damage, and Liability
The Lessee shall bear full responsibility and liability for any loss, theft, or damage to the equipment from the time of dispatch until its return to the Lessor.
The Lessee shall ensure that the equipment is adequately insured for the entire duration of the hire period.
6. Health and Safety
If the Lessee or its personnel are not fully conversant with the operation of the equipment, they must contact the Lessor to obtain appropriate operating instructions before use.
The Lessee shall ensure that all personnel operating the equipment have received proper training, supervision, and safety instructions, and comply with all applicable health and safety regulations.
7. General Conditions
Any repairs required due to misuse, abuse, or accidental damage will be charged additionally.
All rates and terms are subject to the validity of the Hire Quotation.
This Agreement shall be governed by the applicable laws of the jurisdiction in which the equipment is supplied.
